• Attempt to impersonate another user or person or use the username of another user.

• Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services.

• Attempt to bypass any measures of the Services designed to prevent or restrict access.

• Harass, annoy, intimidate, or threaten any of our employees or agents.

• Delete the copyright or other proprietary rights notice from any Content.

• Copy or adapt the Services’ software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.

• Upload or transmit viruses, Trojan horses, or other harmful material.

• Upload or transmit any material that acts as a passive or active information collection or transmission mechanism (e.g., spyware).

• Use, launch, develop, or distribute any automated system (such as spiders or robots) to access the Services without authorization.

• Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.

• Use the Services in a manner inconsistent with any applicable laws or regulations.

• Use a purchasing agent or buying agent to make purchases on the Services.

• Sell or otherwise transfer your profile.

• Resell, redistribute, or share eSIM data plans with unauthorized third parties.

• Use an eSIM plan for commercial purposes other than those expressly permitted.

• Use eSIM data in a way that significantly exceeds normal usage patterns or disrupts network services.

• Use an eSIM for activities that cause network congestion or denial-of-service attacks.

• Attempt to bypass or circumvent data usage restrictions or limits.

• Use an eSIM on incompatible, unauthorized, stolen, or lost devices.

• Use fraudulent or unauthorized payment methods to top-up an eSIM.

• Attempt to reverse or dispute legitimate top-up transactions without valid cause.

• Provide false or misleading information during the top-up process.

• Share account credentials or allow unauthorized access to eSIM accounts.

• Attempt to manipulate or exploit system vulnerabilities or pricing errors.

• Use automated scripts or bots to perform top-ups or other actions.

• Abuse the refund policy or make repeated fraudulent refund requests.

• Use eSIM services for any illegal activities, including but not limited to, fraud, terrorism, or distribution of illegal content.

• Transmit or distribute malicious content, including malware, viruses, or other harmful software.

• Distribute hate speech or content that incites violence.

• Infringe upon intellectual property rights, including copyright or trademark infringement.

• Send spam or unsolicited communications through the eSIM services.

• Impersonate MyDataSky staff or other users.

Contributions

 

In this Policy, the term “Contributions” means:

• Any data, information, software, text, code, music, scripts, sound, graphics, photos, videos, tags, messages, interactive features, or other materials you post, share, upload, transmit, or submit in any way on or through the Services.

• Or any other content, materials, or data you provide to Datasky or use with the Services.

Some areas of the Services may allow users to upload, transmit, or post Contributions. We may, but are not obligated to, review or edit Contributions made on the Services, and we expressly exclude our liability for any loss or damage resulting from the breach of this Policy by any of our users.

You warrant that:

• You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Services, and other users of the Services to use your Contributions.

• All your Contributions comply with applicable laws and are original and truthful (if they represent your opinion or facts).

• Your Contributions do not and will not infringe the proprietary rights of any third party.

• You have the verifiable consent, release, and/or permission of each and every identifiable individual person in your Contributions.

You also agree that you will not post, transmit, or upload any Contribution (or any part of it) that is:

• In breach of applicable laws, regulations, a court order, contractual obligation, this Policy, our Legal Terms, or a legal duty.

• Defamatory, obscene, offensive, hateful, demeaning, intimidating, bullying, abusive, or threatening to any person or group.

• False, inaccurate, or misleading.

• Includes child sexual abuse material, or violates any applicable law concerning child pornography or otherwise intended to protect minors.

• Promotes violence, advocates the violent overthrow of any government, or incites, encourages, or threatens physical harm against another.

• Discriminatory based on race, sex, religion, nationality, disability, sexual orientation, or age.

• Infringes, or assists anyone in infringing, any third-party intellectual property rights or rights of publicity or privacy.

• Deceitful, misrepresents your identity or affiliation, or misleads anyone as to your relationship with us.

• Contains any unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, or mass mailings.

 

Reviews and Ratings

 

When your Contribution is a review or rating, you also agree that:

• You have firsthand experience with the goods, services, or software being reviewed.

• Your Contribution is an honest expression of your experience.

• You are not affiliated with competitors (for negative reviews) or the owner/manufacturer (for positive reviews).

• You cannot offer any conclusions as to the legality of conduct.

• You will not organize a campaign encouraging others to post reviews, whether positive or negative.

Consequences of Breaching this Policy

 

The consequences for violating our Policy will vary depending on the severity of the breach and the user’s history on the Services. For example:

In some cases, we may give you a warning and/or remove the offending Contribution. However, if your breach is serious or if you continue to breach our Legal Terms and this Policy, we have the right to suspend or terminate your access to and use of our Services and, if applicable, disable your account. We may also notify law enforcement or take legal action against you when we believe there is a genuine risk to an individual or a threat to public safety. We exclude our liability for all actions we may take in response to any of your breaches of this Policy.

Datasky is not obligated to monitor user activities, and we disclaim any liability for any misuse of the Services by any user. Datasky is not responsible for any user or other content or Contribution and is not obligated to monitor or exercise any editorial control over such material. If Datasky becomes aware that any such Content or Contribution violates this Policy, Datasky may, in addition to removing it and blocking your account, report such violation to the police or the appropriate regulatory authority. Unless otherwise stated in this Policy, Datasky disclaims liability to any person who has not entered into an agreement with Datasky for the use of the Services.
